Personal data protection

I. Basic provisions

  1. The controller of personal data pursuant to Article 4(7) of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as the “GDPR”) is IDEATECH, s.r.o. Company ID No. 05090521, with its registered office at Dlouhá 730/35, Prague - Staré Město, Postal Code 110 00 (hereinafter referred to as the "controller").

  2. The controller's contact details are

  1. Personal data means any information relating to an identified or identifiable natural person; An identifiable natural person is a natural person who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

  2. The controller has not appointed a data protection officer.

 

II. Sources and categories of personal data processed

  1. The controller processes personal data that you have provided to them or personal data that the controller has obtained on the basis of fulfilling your order.

  2. The controller processes your identification and contact details and data necessary for the performance of the contract.

 

III. Legal basis and purpose of personal data processing

  1. The legal basis for the processing of personal data is

  2. the performance of a contract between you and the controller pursuant to Article 6(1)(b) of the GDPR,

  3. the controller's legitimate interest in providing direct marketing (in particular for sending commercial communications and newsletters) pursuant to Article 6(1)(f) of the GDPR,

  4. your consent to processing for the purposes of providing direct marketing (in particular for sending commercial communications and newsletters) pursuant to Article 6(1)(a) of the GDPR in conjunction with Section 7(2) of Act No. 480/2004 Coll., on certain information society services, in the event that no goods or services have been ordered.

  5. The purpose of personal data processing is:

  • to process your order and exercise the rights and obligations arising from the contractual relationship between you and the controller; when placing an order, personal data necessary for the successful processing of the order (name and address, contact details) are required; the provision of personal data is a necessary requirement for the conclusion and performance of the contract; without the provision of personal data, it is not possible to conclude the contract or for the controller to perform it;
  • sending commercial communications and performing other marketing activities.
  1. The controller does not carry out automatic individual decision-making within the meaning of Article 22 of the GDPR. You have given your explicit consent to such processing.

 

IV. Data retention period

  1. The controller retains personal data

  2. for the period necessary to exercise the rights and obligations arising from the contractual relationship between you and the controller and to enforce claims arising from these contractual relationships (for a period of 15 years from the termination of the contractual relationship).

  3. until consent to the processing of personal data for marketing purposes is revoked, for a maximum of 5 years, if personal data is processed on the basis of consent.

  4. After the expiry of the personal data retention period, the controller will delete the personal data.

 

V. Recipients of personal data (subcontractors of the controller)

  1. The recipients of personal data are persons

  2. involved in the delivery of goods/services/payment processing on the basis of a contract,

  3. providing website operation services and other services related to website operation,

  4. providing marketing services.

  5. The controller does not intend to transfer personal data to a third country (outside the EU) or to an international organisation. Recipients of personal data in third countries are providers of mailing services/cloud services.

 

VI. Your rights

  1. Under the conditions set out in the GDPR, you have

  2. the right to access your personal data pursuant to Article 15 of the GDPR,

  3. the right to rectify personal data pursuant to Article 16 of the GDPR, or to restrict processing pursuant to Article 18 of the GDPR.

  4. the right to erasure of personal data pursuant to Article 17 of the GDPR.

  5. the right to object to processing pursuant to Article 21 of the GDPR, and

  6. the right to data portability pursuant to Article 20 of the GDPR.

  7. You also have the right to lodge a complaint with the Office for Personal Data Protection if you believe that your right to personal data protection has been violated.

 

VII. Conditions for the security of personal data

  1. The controller declares that it has taken all appropriate technical and organisational measures to secure personal data.

  2. The controller has taken technical measures to secure data storage and personal data storage in paper form.

  3. The controller declares that only persons authorised by it have access to personal data.

 

VIII. Information on the processing of personal data for the purpose of responding via the contact form

  1. IDEATECH, s.r.o., with its registered office at Prague - Staré Město, Dlouhá 730/35, Postal Code 110 00, ID No. 05090521, registered with the Municipal Court in Prague, Section C, File 258199, processes the following personal data within the contact form in accordance with Regulation (EU) No. 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as the "Regulation"):

  • First name and surname;
  • Email address;
  • Message;
  1. in accordance with applicable law, for the purpose of responding to your enquiry. Personal data will be stored and processed for the above purpose for a period of 6 months from the date of sending the message in the contact form, unless another legal regulation requires the communication to be stored for a longer period. The above processing is permitted on the basis of Article 6(1)(b) of the Regulation – processing necessary for the performance of a contract or in order to take steps at the request of the data subject prior to entering into a contract.

  2. Your first name, surname and email address will be processed for the purpose of enabling communication between you and the company.

  3. The processing of personal data is carried out by IDEATECH, s.r.o., i.e. the personal data controller.

  4. Please note that under the Regulation, you have the right to:

  • request information from us about what personal data we process
  • request access to this data and have it updated or corrected, or request a restriction on processing,
  • request that we erase this personal data – we will erase it if this erasure does not conflict with the provisions of this article and the legitimate interests of our company,
  • contact us or the Office for Personal Data Protection in case of doubt about compliance with obligations related to the processing of personal data.

 

IX. Final provisions

  1. By submitting an order from the online order form, you confirm that you are familiar with the terms and conditions of personal data protection and that you accept them in their entirety.

  2. The controller is entitled to change these terms and conditions. The new version of the personal data protection terms and conditions will be published on its website and at the same time sent to you at the e-mail address you provided to the controller.

 

These terms and conditions come into effect on 25 May 2018.
